Penalties for Convictions in Kansas

Several laws enacted in 2011 make the penalties for second, third, or fourth DUIs even harsher than before, with increases in fines, mandatory jail time and driver's license revocation. For a second DUI you will have to serve from 90 days to 1 year in jail and your fine will be from $1,250 to $1,750. Your license will be suspended for a year and after this time, an ignition interlock device will be required on your vehicle. For a second offense you will have to complete a court ordered treatment program.

A third DUI conviction will either be a misdemeanor, or felony (depending upon whether there was a prior DUI conviction within the past 10 years) offense with a jail sentence of 90 days to 1 year and fines from $1,750 to $2,500. With a third DUI, you must serve 48 consecutive hours in jail prior to any work release, or house arrest, program going into effect. License suspension is for 1 year with an ignition interlock device being installed after your suspension is completed. Additionally, your vehicle may be impounded for up to a year.
